We invite you to carefully read these General Conditions of Sale before making a purchase. By making any purchase, you fully accept these General Conditions of Sale.
These general conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products" or "Product") purchased through the website https://fvscosmesi.com (hereinafter , "Site"). The use of the distance selling service described in these General Conditions is reserved exclusively for sector operators and holders of VAT numbers (hereinafter, "Customers" or the "Customer").
All commercial relations between FVSCOSMESI di Ammoscato Victoria and the Customer are governed exclusively by the following general conditions of sale, unless expressly waived by special conditions agreed in writing with FVS COSMESI of Ammoscato Victoria and countersigned by both parties for acceptance.
The online sale is carried out after registration, free and non-binding, and approval of FVS COSMESI di Ammoscato Victoria which reserves the right to cancel any registration with a simple communication via email, even without providing any justification. The language available to conclude the contract is Italian.
The Customer is required to carefully read the General Conditions that have been made available to him on the Site, in order to allow them to be stored and reproduced by the Customer pursuant to art. 12 of the Legislative Decree 9 April 2003, n. 70. The contracts concluded with FVSCOSMESI (as defined below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70 (hereinafter, "Ecommerce Decree").
IDENTIFICATION OF THE SELLER
The seller is FVS Cosmesi di Ammoscato Victoria, registered office: Viale G. Mazzini 28, 00015 MONTEROTONDO (RM), VAT number 15265581007 (hereinafter “FVS COSMESI”).
INFORMATION RELATING TO PRODUCTS
The information relating to the «DERMOGENERA» Products which can be sold remotely through the Site are available, with the relevant product information, on the Site. The aforementioned information is provided in compliance with articles 52 and 53 of the Consumer Code. Product prices are exclusive of taxes and duties. Transport costs for the delivery of products to the customer's home and other charges attributable to the chosen payment method are excluded. All prices are expressed in Euros.
ORDER OF PRODUCTS
The essential characteristics and prices of the Products are shown in the offer relating to each Product. To purchase the Products, the Customer must complete and send the order following the instructions contained on the Site. The Customer must place the Product in the appropriate "cart" and, after having read the General Conditions, with particular reference to the contribution for the delivery costs, the types of payment, the methods of exercising the right of withdrawal and the Privacy Policy, must select the desired payment method and choose the "send order" option. Before submitting your purchase order, the Customer will have the possibility to correct any errors in entering data by following the appropriate modification procedure contained in the Site. In particular, the Customer has the right to change the quantity of the Products he intends to purchase, adding or deleting one or more Products from the "cart". By sending the order, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions.
Orders, even if confirmed, are considered accepted except for any price increases imposed by suppliers or deriving from circumstances beyond the control of FVS COSMESI. In this case, FVS COSMESI will have the right to increase the sales prices charged to the Customer in proportion to the increase it undergoes. FVSCOSMESI will notify the Customer of any inability to accept orders received within 48 hours from the business day following the one on which the Customer has sent the order and will refund any sums already paid by the Customer for the payment of the supply. The Customer may request the total and / or partial cancellation of the order. However, FVSCOSMESI will have the right to accept or refuse the cancellation. The cancellation request must be sent by e-mail or web.
PRICES AND AVAILABILITY
All prices are inclusive of VAT applicable by law.
Information on the availability of the products we sell is listed on the site, as well as on the presentation page of each product. In addition to the information provided on this page or elsewhere on the site, we are unable to give more precise information on the availability of products. Please consider that the estimated times for sending and delivering the products are purely indicative and it is not possible to fully rely on them. Once we have received your order, we will notify you by email if any of the products you have ordered are not available.
PAYMENTS
FVS COSMESI accepts payments made in the following ways:
Advance bank transfer
PayPal account or credit card *
* The management of credit cards is entrusted to PayPal which accepts the most common credit cards even if you do not have a PayPal account. For information relating to the security of transactions, please refer to the information on the PayPal website which can be viewed by clicking the following link ( https://www.paypal.com/it/webapps/mpp/home ).
An additional charge equal to 3.4% of the taxable amount of the order is applied to payment via PayPal or Credit Card;
For payment on delivery, an additional charge equal to 3% of the taxable amount of the order is applied, with a minimum of 3.00 Euros, as a reimbursement for the management of collection costs by the Courier. This payment method is not accepted by black-listed customers who have previously rejected product deliveries without any valid reason.
Rejecting a delivery without reason or dropping it in storage and returning to the sender, imposes the obligation of compensation for double shipping costs according to the following table, in addition to any storage costs, to be paid by bank transfer, under penalty of activation of a credit recovery.
DELIVERY
We ship our Products by courier. Deliveries are made on working days (Monday to Friday). In case of absence, the Customer, or the recipient of the ordered products, will receive a notice of attempted delivery, with which they can contact the carrier at the address indicated on the notice in order to organize a new delivery. In the event that it is expressly indicated by the Customer, or by the recipient of the ordered products, it will be possible to deliver the products to a third party.
If not contacted, the Carrier will carry out a further step, following the first step. In the event that after two delivery attempts it was not possible to deliver the package, the Customer or the recipient of the Order will receive a notice communicating the address of the Carrier's Center where the package will be stored for ten working days. The Customer or the recipient of the Order will be able to collect the package at this Center. At the end of this term, the package will be returned to FVS Cosmesi and the Customer will be reimbursed, in the manner chosen at the discretion of FVS Cosmesi, of the amount of his Order minus shipping costs.
It is not possible to raise any dispute relating to the shipment itself in the event that the package appears to have been delivered. For this purpose, the Carrier's computer system is valid
SHIPPING FEES
As reported below, the shipping costs are calculated based on two factors: the amount of the 'Cart' net of any discounts and / or promotions and place of delivery. Transport costs are divided into two price ranges, calculated according to the amount of the purchase. For disadvantaged areas a flat rate supplement of € 11.00 including VAT is applied to both price ranges.

Unless otherwise specified, the Products will be delivered by FVS COSMESI to the billing address indicated by the Customer.
ELECTRONIC BILLING
Law no. 205 of 27 December 2017 (the so-called "Budget Law 2018") introduced, starting from 1 January 2019, the obligation of electronic invoicing for the sales of goods and services provided between private, resident, stable economic operators or identified in the territory of the Italian state.
The electronic invoice replaces the paper version, which will no longer be valid from January 1st, and must comply with the requirements in order to be accepted by the Interchange System (SDI).
In order to prevent the Exchange System from rejecting our Invoices or not being able to deliver them correctly, it is necessary to indicate in the cart under 'Electronic Invoice Delivery' your Recipient Code (consisting of 7 digits) or alternatively your e PEC email. In the absence of such data, the system may not deliver the invoice correctly.
DELIVERY TIME
We ship our Products by express courier. After sending the Order Completed Notice e-mail, the courier is requested to take delivery which approximately takes from 24 to 48 hours to deliver the package in ITALY and from 48 to 72 hours to deliver the package in the ISLANDS and LOCALITIES. DISCOMFORT.
Attention: the bank transfer does not guarantee immediate shipment! By choosing the bank transfer as payment, the products will be prepared and sent only when the transfer is credited to our bank. DAMAGES DUE TO TRANSPORT RTO
If, upon arrival of the courier, the package appears to be damaged, choose the “conditional acceptance” or “intact package control reserve” option: this is a formula that indicates that you have received the package, but that something may have gone wrong. If the package seems intact, but you assume that the contents could be damaged anyway (for example because you hear the sound of broken glass), still choose the formula with reserve.
The reserve allows you to check the content at a later time, since the courier by law does not allow you to open the package until you have signed.
ATTENTION: if you accept without reservation, sign a document that says that the package has arrived in perfect condition, and at that point it is impossible to request a refund. To accept a parcel with reserve, you need to fill in specific fields in the document that the courier will ask you to sign upon delivery. Each courier has its own procedures, so you should ask the driver who is doing the delivery what you need to do.
In order to allow us to refund / replace any goods damaged in transport, the Customer is required to provide photos of the damage as proof of the same.
LIMITATION OF LIABILITY
Should FVSCOSMESI be held responsible for the total or partial non-fulfillment of its obligations deriving from the contract, the total compensation due to the Customer may in no case exceed 10% of the price of the goods that caused the damage.
RIGHT OF WITHDRAWAL
As per current legislation, the customer has the right to withdraw within 14 days of receipt of the goods, calculated from the date of receipt of the package. To exercise the Right of Withdrawal, the Customer will send an e-mail to info@dermogenera.com declaring that he wants to make use of the Right of Withdrawal, clearly indicating the date of the invoice, the number, description and quantity of the goods. Only after our confirmation, the goods must be returned only with traceable shipping. The returned merchandise must be new, undamaged, unused, unwashed, undamaged and as originally sent. The shipping costs for the return are charged to the customer. The goods travel at the risk and peril of the customer, so we recommend packing them properly to avoid damage during transport. When we have received the goods intact, we will refund the cost of the Products for which the withdrawal is exercised and any transport costs incurred to receive the Products. The refund will be made within 30 days from the date of receipt of the products covered by the withdrawal.
ORDER CONFIRMATION
In compliance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of execution of the contract, by email, the confirmation of receipt of the purchase order sent by the Customer. INEFFECTIVENESS OF THE ORDER
No contract must be considered concluded between FVS COSMESI and the Customer if FVSCOSMESI has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the products ordered, or abuses the right of withdrawal. In such cases, the order forwarded by the Customer must be considered ineffective. FVS Cosmesi will send to the Customer, by e-mail, a communication certifying the non-conclusion of the Contract, also taking care of the cancellation of any charge and / or expense charged to the Customer.
MISTAKES
The information relating to the Products provided on the Site is constantly updated. However, the complete absence of errors cannot be guaranteed. FVS COSMESI reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update information at any time without prior notice.
CHANGES TO THE GENERAL CONDITIONS OF SALE
We reserve the right to modify the site, policies and these General Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. You will be subject to the policies and terms of the General Conditions of Sale from time to time in force at the time you order products from us, unless any changes to these policies and terms are required by applicable law or competent authorities (in which case , they will also apply to orders you have previously placed). If any provision of these conditions is deemed invalid, null or for any reason unenforceable, this condition will in any case not affect the validity and effectiveness of the other provisions.
APPLICABLE LAW AND JURISDICTION
These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law. For disputes arising from the interpretation, validity and / or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the Rome forum.
DISCLAIMER OF LIABILITY
Cosmetics cannot be considered resolutive of pathologies that require medical treatment. The advice we provide cannot in any way replace those of doctors and specialists. Before using any cosmetic it is good to carry out a tolerance test by applying it to a small area of the body. FVS COSMESI is not to be held responsible in any way for the incorrect use of the resold products or for any allergic reactions connected to them.
